Case Study: Premise Liability Personal Injury

When Just Being Careful Isn’t Enough

Design flaws and inadequate lighting can create treacherous environments where even the most cautious people are at risk of injury. Variations in stair tread height, improperly designed handrails, and insufficient lighting are all common culprits in premises liability cases. By failing to address these hidden dangers, building management leaves individuals vulnerable to accidents that could have been prevented through proactive maintenance and adherence to safety codes.

A recent incident in Lake Charles underscores this reality, where a woman suffered significant injuries after falling in an apartment complex stairwell. This accident was not the result of personal negligence or a lack of attention; rather, the stairwell’s architectural design and low visibility created hazardous conditions that made safely navigating the steps nearly impossible.

Our client was holding the handrail while descending the poorly lit stairwell at a local apartment complex, unaware that the handrail abruptly ended where the stair geometry changed. Combined with the dim lighting, the change in tread depth made the step nearly invisible, causing a fall that resulted in a shoulder injury, significant spinal damage, and surgical intervention.

Safety Should Never Be A Step Behind

Two law firms had previously declined this case, thinking that proving liability would be difficult. Premises liability claims involving stairs require careful analysis of design standards, safety practices, and how people perceive steps in real-world conditions. The central issue was showing how the stair design and lighting created a hazard that someone using the stairs normally would not notice.

Our approach combined expert evaluation and thorough investigation. We hired a human factors expert to assess the stair geometry and lighting, confirming that the dim conditions made it extremely difficult to see the sudden change in tread depth at night. We also deposed apartment employees and managers, uncovering that the defect had gone unnoticed due to insufficient training. To clarify the hazard, we created visuals to compare proper stair design to the complex’s stairwell, which helped establish noncompliance and strengthened our case.

The result was a settlement from the first layer of insurance, just weeks before trial. Though the fight with excess carriers continues, this outcome allows our client to move past the stress of her injury and surgery. This case underscores the importance of holding property owners accountable for unsafe conditions that can cause serious injury. Even when liability seems difficult to prove, careful investigation, expert analysis, and clear presentation of the facts can make a real difference.
